1. Do you think Starbuck's is being unreasonable to ask Sam to change the name of her coffe shop? 2. Do you think Sam chose the name to play off against the Starbuck's name? 3. Part of the problem of ignoring possible trademark infringements that may seem insignificant is that the courts read any failure to protect your trademark as good reason for the courts to not help you protect it later when you find the infringement significant. As the trademark attorney in the clip noted, Elevator, Thermos, Aspirin, and Trampoline all lost their rights to their trademarks, because they didn't "police" their trademarks. What should the courts' role in this be in the trademark infringement dispute? 4. Do you think Sam should have been able to keep her store name as "sambuck's"? |
